LIABILITY WAIVER

I attest, as a participant, or as the parent or legal guardian of the minor referred to as participant in Valentina Kozlova Dance Foundation, Inc. (herein referred to as VKDF) dance classes, that should the participant take part in the aforementioned dance program, the participant is physically fit to participate in the physical activity program known as and associated with any VKDF dance classes and performances including those that are offsite. Participant herein refers to the dancer, if over 18, or to the parent(s) or legal guardian(s) if dancer is under 18 years of age. 

In participating in VKDF dance classes, including, but not limited to, individual or group classes, performances, workshops, or other activity organized by VKDF, participant hereby waives and releases all claims, liabilities, actions, damages, costs or expenses of any nature whatsoever for injuries the participant might sustain, known or unknown, arising out of the program now or at all times in the future. 

I understand that certain corrections may include manual physical contact and manipulation. Participant recognizes and acknowledges there is risk involved with participating in the activities associated with the instruction of dance, and agrees to assume risk for any such activities connected with VKDF dance classes or other activities. Participant accepts liability for any property damage that may occur as a result of participant's instruction. Moreover, participant understands and accepts that no promises or guarantees are made, explicit or implied. 

The registered participant or, in case of a minor the parent(s) or legal guardian(s) agrees to indemnify and hold harmless VKDF or any instructor(s) associated with the program, from and against any and all liabilities, claims, actions, damages, costs or expenses of any nature whatsoever, whether in law or equity, known or unknown, incurred by VKDF and arising out of, or in any way related with, directly or indirectly, the participation in all VKDF programs, classes and auditions in the studios as well as outside performances. By registering for VKDF programs, participant agrees to the terms outlined in this liability waiver and release. Participant also agrees to abide by all VKDF guidelines. 

 PHOTO / VIDEO RELEASE

I do hereby grant Valentina Kozlova Dance Foundation, Inc., also known as VKDF, its assigns, licensees, successors in interest, legal representatives and heirs the perpetual and irrevocable right to use my name or any fictional name (dancer over 18) or my child's name or any fictional name (dancer under 18), picture, portrait, photograph, movie or videos in all forms and in all media and in all manners, without any restrictions as to changes or alterations (including but not limited to composite or distorted representations or derivative works made in any medium) for editorial, advertising, trade promotion, exhibition, or any other lawful purposes, and I waive any right to inspect or approve the photograph(s) or finished version(s), including written copy that may be created and appear in connection therewith. I hereby release and agree to hold harmless the Photographer, his or her assigns, licensees, successors in interest, legal representatives, and heirs from any liability by virtue of any blurring, distortion, optical illusion, or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of the photographs, or in any processing tending toward the completion of the finished product, unless it can be shown that they and the publication thereof were maliciously caused, produced, and published solely for the purpose of subjecting me, or my child, to conspicuous ridicule, scandal, reproach, scorn and indignity. I agree that VKDF (herein referred to as the “Photographer”) owns the copyright of these photographs and videos and I hereby waive any claims I may have based on any usage of the photographs or works derived there from, including but not limited to claims for either invasion of privacy or libel. I agree that this release will be binding on me, my legal representatives, heirs and assigns. I have read this release and am fully familiar with its contents.
